1. Acceptance of Terms
By accessing or using Whillo ("Service"), operated at whillo.io, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, viewers, streamers, and other users.
2. Eligibility
You must be at least 18 years of age to use Whillo. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at [email protected] of any unauthorized access.
4. Viewer Terms
Viewers pay a one-time $1 activation fee to access the earning features of the platform. Viewers may earn money for watching qualifying streams up to the daily limit set by Whillo, which may change at our discretion with notice. Earnings are credited to your Whillo balance and may be withdrawn once the minimum payout threshold ($5.00) is reached. Whillo reserves the right to withhold earnings if fraudulent or automated activity is detected. Viewer accounts are personal and non-transferable.
5. Streamer Terms
Streamers subscribe to monthly plans that provide viewer slots. Subscriptions are billed monthly via Stripe. You may cancel at any time; access continues until the end of the billing period. Streamers are responsible for ensuring their content complies with applicable laws and platform guidelines. Whillo reserves the right to remove streamer accounts that host illegal, harmful, or deceptive content.
6. Payments and Payouts
Streamer subscription fees are billed and processed by Stripe. By subscribing, you agree to Stripe's Terms of Service. Viewer earnings are disbursed via PayPal to the PayPal email address associated with your account. Viewer payout requests are processed within 5–7 business days of approval. Whillo is not liable for delays caused by third-party payment processors. All fees are in USD. Refunds on activation fees and subscriptions may be requested within 7 days of a charge by contacting [email protected].
7. Prohibited Conduct
You may not: use bots, scripts, or automated tools to simulate viewing; create multiple viewer accounts to multiply earnings; share account credentials; upload or transmit harmful, illegal, or infringing content; attempt to reverse-engineer or exploit the platform; or engage in any activity that disrupts the Service or other users.
8. Intellectual Property
All platform content, branding, and code are the property of Whillo or its licensors. You retain ownership of content you submit but grant Whillo a non-exclusive license to display it as part of the Service. You may not use Whillo's trademarks without written permission.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WHILLO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. VIEWER EARNINGS ARE NOT GUARANTEED AND MAY VARY.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHILLO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO WHILLO IN THE 3 MONTHS PRECEDING THE CLAIM.
11. Termination
Whillo may suspend or terminate your account for violations of these Terms, fraudulent activity, or at our discretion with reasonable notice. Upon termination, your right to use the Service ceases. Earned, unpaid balances above the payout threshold will be paid out within 30 days of termination unless forfeited due to fraud.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration under the AAA rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
13. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or prominent notice on the site at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
